These Terms of Use ("Terms") form a binding agreement between you and BanyanTree Consulting LLC ("we", "us", "our", or "ExpenseLogify") governing your access to and use of the ExpenseLogify application, website, and related services (collectively, the "Service").
By creating an account, checking the "I agree" box at signup, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed these Terms and consents to your use. You may not use the Service if you are prohibited from doing so under applicable law or if your account has previously been terminated by us.
You represent that you are using the Service for your own personal, non-commercial financial tracking. Business, professional, or fiduciary use requires our prior written consent.
2. Your account
You agree to:
- Provide a valid email address and accurate information at signup;
- Choose a strong, unique password (minimum 8 characters) and keep it confidential;
- Notify us promptly at support@expenselogify.com if you suspect unauthorized access;
- Take responsibility for all activity that occurs under your account.
You may review and revoke active sessions from the security panel in your profile at any time. We may require re-authentication for sensitive actions such as password changes or account deletion.
3. The Service
ExpenseLogify is a personal budgeting Progressive Web App that lets you manually record income and expenses, define budgets and financial goals, capture transactions via voice or receipt scan, generate reports, and receive AI-generated coaching insights. Specifically, the Service does not:
- Connect to or aggregate data from your bank, brokerage, or credit-card accounts;
- Move money, process payments, or hold funds on your behalf;
- Offer investment, tax, or legal advice, or manage assets for you.
All financial figures reflect only what you (or automated features you enable) enter into the app. Accuracy of your data is your responsibility.
4. AI-generated content
The Service uses third-party artificial intelligence models — currently Google Gemini (receipt OCR, item mapping, financial coaching) and OpenAI Whisper (speech-to-text) — to power certain features. AI outputs are probabilistic and may be:
- Incomplete, inaccurate, or reflect the model's training biases;
- Inconsistent across identical inputs;
- Occasionally "hallucinated" (plausible but wrong).
5. No financial, tax, or legal advice
The Service is a self-service budgeting tool. Nothing in the Service — including reports, projections, categorizations, budget suggestions, or AI coaching content — constitutes financial, investment, accounting, tax, or legal advice. We are not a bank, broker-dealer, investment adviser, or fiduciary. Before making significant financial decisions, consult a qualified professional.
6. Your content & license to us
You own your data. Transactions, receipts, categories, budgets, goals, shopping lists, and any text or images you upload ("Your Content") remain your property.
To operate the Service you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and back up Your Content solely for the purpose of providing the Service to you and improving its reliability. We do not use Your Content to train AI models, sell it to advertisers, or share it with data brokers.
You may export or permanently delete Your Content at any time from your profile settings, as further described in our Privacy Policy.
7. Acceptable use
You agree not to, and not to permit anyone else to:
- Use the Service to record fraudulent, illegal, or misleading financial activity;
- Impersonate another person or misrepresent your identity;
- Upload malware, viruses, or content designed to disrupt the Service or its users;
- Attempt to gain unauthorized access to other accounts or our systems;
- Scrape, spider, or systematically extract data from the Service without our written permission;
- Reverse engineer, decompile, or attempt to derive source code, except as permitted by law;
- Circumvent rate limits, quotas, or security measures;
- Use the Service for commercial, business, or fiduciary purposes without our consent (see Section 1);
- Resell, sublicense, or offer the Service to third parties;
- Upload content that infringes any third-party right, is defamatory, harassing, or violates any law.
We may investigate suspected violations and cooperate with law-enforcement agencies as required by valid legal process.
8. Fees
The Service is currently offered free of charge. We reserve the right to introduce paid plans or premium features in the future. If we do, we will notify you in advance, and any charges will be clearly disclosed before you incur them. Continued use of previously-free features that later become paid is entirely optional — you can decline and continue with the free tier or delete your account.
9. Third-party services
The Service integrates with third-party providers to deliver certain features — including Google Gemini and OpenAI Whisper (AI processing), Resend (transactional email), and cloud infrastructure providers. Your use of these features is also subject to the respective providers' terms and privacy policies. We are not responsible for the acts, omissions, or content of third parties.
10. Suspension & termination
By you: You may stop using the Service and delete your account at any time from Profile → Data & Privacy. Deletion is permanent and cannot be undone.
By us: We may suspend or terminate your access without prior notice if we reasonably believe you have violated these Terms, if required by law, or if continued access poses a security or integrity risk to the Service. Where feasible, we will give you an opportunity to export your data before deletion.
Sections that by their nature should survive termination (including 6, 11, 12, 13, 14, and 15) will remain in effect.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that AI outputs, reports, projections, or coaching recommendations will be accurate, complete, or suitable for your particular circumstances. You use them at your own discretion and risk.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BANYANTREE CONSULTING LLC, ITS AFFILIATES, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100.
Some jurisdictions do not allow the limitation or exclusion of certain warranties or damages, so some of the above may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless BanyanTree Consulting LLC and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your violation of these Terms, or (c) your violation of any law or third-party right.
14. Governing law & venue
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. You and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and each party consents to personal jurisdiction and venue there.
Nothing in this section limits either party's right to seek injunctive or other equitable relief in any competent court to protect its intellectual property or confidential information.
15. Intellectual property
The Service, including its software, design, logos, and content authored by us, is owned by BanyanTree Consulting LLC or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms. No other rights are granted.
"ExpenseLogify" and related logos are trademarks of BanyanTree Consulting LLC. All other marks are property of their respective owners.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and, for signed-in users, prompt you to review and re-accept the revised Terms before you can continue using the Service. Non-material changes take effect upon posting.
17. Miscellaneous
Entire agreement. These Terms together with the Privacy Policy constitute the entire agreement between you and us regarding the Service and supersede prior agreements.
Severability. If any provision is held unenforceable, the remaining provisions will remain in full effect.
No waiver. Our failure to enforce any right or provision is not a waiver of that right.
Assignment. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, internet outages, third-party provider failures).
